Help Moms demolished house don't know what to do

The insurance adjuster is about $15,000 away from my lowest bid to get the house repaired. He is cutting a check today and is going to be out of the office til Jan 3rd. He says cash the check and start the work and he will compare estimates when he is back in the office to see where the differences are.

Anyone know should I?

also call back your insurance company and let them know what is going on and maybe they can get a manager or some one to help you. Maybe just maybe you won't have to wait. I would call and explain the situation and ask them.

That is what I'm worried about. I specificatly ask him this yesterday, if that would constitue settled. He said no, that would be considered a partial payment until he could compare his estimate with the written quotes. I asked him if there would be a letter to that fact and he said no, I feel a flim flam but don't know what to do. Right now we are $5,000 owed just to get the 2 trees off the house. This was the only tree people willing to do it now, the rest were busy this week. It has rained 3 times since last week and the adjuster said he would not pay for damage caused by the rain we should have gotten the tree off. But how? They all want payment.

For that much of a difference on the lowest bid you found, do not go ahead with the repair UNTIL the insurance accepts one of the bids you presented to them. Cashing the check means that you've accepted their terms and they consider the claim as settled in full UNLESS you clarify that directly with the insurance company (if you call them, it is best if call is recorded on their end for quality service and should you file a dispute later, the call can be retrieved easily) that you do not consider it as full settlement on your claim. If they say that you can start with the repair and they'll send you another check for the $15K balance, then you know you will be getting another check sometime later.

Not really the same but this is what our insurance did with major car repair after an accident. We found someone in town who had experience with insurance claims and spoke with them did not get any estimates but asked them the procedure. He told us exactly how to handle the insurance and that in the case of overage they would call the adjuster back out to evaluate the reasons to request more repairs. Stil we got no estimates. Ins adjuster came to our car did an estimate and cut us a check. We spoke with the adjuster before taking the check about how he would handle overages the story matched the body shop. The body shop compared estimate with their personal estimate and made a match (they knew what the check was for and knew that was guaranteed payment). There were overages and the body shop absorbed some and requested some but they handled it in the end. The check was never cashed it was exchanged after services just like a normal payment. I know that all may mean nothing but I would call around do not even mention what estimates you have and explain what the insurance has done. We asked our adjuster for people in our area he had worked with and that helped too. Don't cash the check. Use that for your payments. Remember that check has any deductibles removed

Believe it or not, you're responsibile for getting the tree off the house and a tarp or something covering the hole. They don't care if you have the money or not.

I know when tornadoes come through here, they always say on the local TV news that if you have roof damage, you're responsible for getting the roof covered and ensuring the severity of the damage isn't worsened by rain, etc.

If it's a partial payment, they can provide you with it in writing, otherwise, it's suspect behavior on their part.

ask him to put that in writing and have that letter in your hand prior to cashing the check. (can they fax it to you/you pick up the letter?)

My Moms pipes burst. Her and my Dad paid insurance for 39 years on a house they never had one claim on, then the one time she needed it they were screwing her. The work man made excuses why they didnt have to do somethings they were at it over 3 months and so on. I called Pennsylvania where she lived capital building and they put me in touch with an insurance inspectors who handled complaints and problems. Then they contacted my Mom and helped to see she wasnt cheated, but in the time it took to get the paper work filed a case worker etc. I told my mom to lay the printed complaints form out on her desk so they could see them, have the camera and walk around taking pictures and they would know now they cant keep messing with her. She did that and the time it took till someone opened a file and contacted her while she let the workers know she was documenting everything they suddenly were on their best behavior and working more throughly. I do have to say for the record it is years later and people are telling her that the work is shoddy and she really needs new ceilings replaced as they did such a poor job. So I don't know what to tell you but I would call the states attorney general office and ask what your rights are and not sign anything until you can seek professional guidance and make sure your not being cheated.
